1. Introduction and Binding Agreement

These Terms and Conditions of Service ("Agreement", "Terms") constitute a legally binding contract between You ("User", "Client") and Yayasan Quran Arabi Internasional ("We", "Us", "Our", or the "Foundation"), which operates the Quran Arabi website ("Website", "Platform"). By registering, accessing, or using the services and Digital Products provided through the Platform, you acknowledge that you have read, understood, and agree to be legally bound by all provisions contained within this Agreement. If you do not agree to these terms, you are strictly prohibited from accessing or using the Website.

2. Description of Services

The Website functions as an electronic educational platform providing access to intellectual property in the form of Arabic language and Islamic religious studies courses, which include videos, audio, text, and other supporting documents ("Digital Products"). We do not provide specific guarantees regarding educational outcomes. All access is contingent upon system availability and your strict compliance with these Terms.

3. Account Registration and Security

Users are required to create a personal account to make purchases and access Digital Products. The User bears full legal responsibility for the security of their login credentials (username and password) and any activities occurring under the account. Account transfer, sale, or sharing of access with third parties is strictly prohibited without written consent from the Foundation. Any indication of account abuse will result in unilateral service termination by Us without any form of compensation.

4. Financial Provisions and Payment

Payment transaction processing is managed by a third party, Paddle.com ("Merchant of Record"). By initiating a financial transaction on the Website, you agree that:

  • The billed price includes Value Added Tax (VAT) or other relevant taxes according to your jurisdiction as determined by Paddle.
  • All payment settlements are subject to Paddle's Terms of Service.
  • The Foundation reserves the right, at its sole discretion, to modify pricing structures at any time without prior notice. Such changes will not apply retroactively to completed transactions.

5. Intellectual Property Rights (IPR) and Licensing

All Digital Products and content published on the Website are the exclusive property of Yayasan Quran Arabi Internasional and are protected by international Copyright laws and the Intellectual Property legislation of the Republic of Indonesia. Upon a successful transaction, the Foundation grants the User a limited, non-exclusive, non-transferable, and revocable license solely for personal, non-commercial educational purposes.

Users are expressly forbidden from: copying, reproducing, distributing, broadcasting, commercially exploiting, downloading outside of permitted mechanisms (e.g., screen-recording), or creating derivative works from the Digital Products without explicit written licensing from the Foundation.

6. Limitation of Liability

To the fullest extent permitted by applicable law, the Foundation shall not be held liable for any direct, indirect, incidental, or consequential damages, including but not limited to loss of profits, loss of data, or cyber attacks resulting from the use or inability to use the Platform. The services are provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties, representations, or conditions of any kind, whether express or implied.

7. Termination and Suspension

We reserve the exclusive right, for security reasons and legal compliance, to suspend or terminate your account and access to the Platform unilaterally and immediately, if there is substantial evidence of a violation of these Terms and Conditions. In the event of termination due to a violation, there shall be no obligation for refunds from the Foundation.

8. Governing Law and Jurisdiction

This Agreement is governed by, and construed in accordance with, the laws of the Republic of Indonesia. Any disputes, controversies, or claims arising in connection with the interpretation or execution of this Agreement, which cannot be resolved through amicable mediation, shall be submitted to the competent district court in the legal domicile of the Foundation in Indonesia.
